  On September 29, 2026, the United States District Court for the Northern District of California (the "Court") ruled on the parties' motions to dismiss in Joby Aero, Inc. v. Archer Aviation Inc., et al., Case No. 5:25-cv-10703-SVK (N.D. Cal.), which the Company previously disclosed. The Court narrowed the claims asserted against the Company and its employee, dismissing certain trade-secret and contract-related claims, with leave to amend in some cases, while allowing other claims to proceed.

  On February 23, 2026, Archer Aviation Inc. filed a patent infringement lawsuit against Vertical Aerospace Ltd. and Vertical Aerospace Group Ltd. in the United States District Court for the Eastern District of Texas. The lawsuit alleges that Vertical's eVTOL Valo aircraft infringes multiple patents owned by Archer relating to its Midnight eVTOL aircraft. Archer seeks an injunction to prevent Vertical from continuing its infringing activities, as well as monetary damages for past infringement.
